Defendant was charged with violation of Wisconsin statute sec. 346.67 (1) (a), (b), and (c) (Failure to Stop After Injury). On November 14, 1966, a pedestrian was struck by an automobile and injured at the intersection of East North avenue and North Cambridge avenue in the city of Milwaukee. The operator of the automobile did not stop. It was stipulated at the time of trial that the automobile involved in the accident was the automobile driven by the defendant on the night of the accident, a car registered in the name of his father. It was also stipulated that the pedestrian was injured in the accident and that at no time did the defendant render any assistance at the time of the accident. Defendant told the police on the morning after the accident that he drove the car to a tavern, had at least ten drinks of brandy, became intoxicated, and woke up that morning with a recollection at that time of having been involved in an accident the night before, that he thought the accident involved his driving off the road somewhere on Capitol Drive and hitting a safety island, that he had only one set of car keys, that he drove from his apartment to his fathers house on the morning of November 14, 1966, at about 8 a. m. Trial was held without a jury and defendant was found guilty as charged and fined in the sum of $1,000. Defendant appeals.
